Terms and Conditions (T&C)

 

This Terms and Conditions (T&C) agreement is the agreement that includes the terms, the rules and the guidelines of acceptable behavior and other useful sections to which users (customers) must agree in order to use or access or register jitben.com (e-commerce website/ online commercial center) and its mobile app. These are the T&C administering your admission and use of jitben.com alongside its related sub-areas, destinations, portable application, and apparatuses (the "Website"). By using jitben.com, you, a registered or guest user in terms of the eligibility criteria set out herein (“User”) agree to be bound by the T&C.

This agreement is considered as successful upon your utilization/use/admission/registration with jitben.com which means your acknowledgment of these T&C. This e-commerce site is designated, claimed and worked as a sister concern of Rinomas Bangladesh Limited, a company formed under the Companies Act, 1994 in Bangladesh. The Website is operated by jitben.com, under the laws of Bangladesh having its registered office at 9/4, Ring Road, Garden Street, Shyamoli, Dhaka, Bangladesh. Use of jitben.com is available ONLY to such individuals/entities that can legally make contract under the Contract Act, 1872. To put it simply, this e-commerce site (jitben.com) may be used by (i) natural persons who have reached 18 years of age and (ii) legal entities (companies, enterprises, and other lawful organizations). Users below the age of 18 must obtain permission from parent(s) or legal guardian(s), who by accepting this T&C agreement shall agree to take responsibility for your actions and any charges associated with your use of this e-commerce website and/or purchase of Goods. We name all of them under the title of “user”.

Almost all contents set out herein are in conformity with “Digital Commerce Operation Guidelines 2021”, (WTO cell, Ministry of Commerce, Circular no: 26.00.000.133.93.026.19.119 dated 04 July 2021) and the contents set out herein form an electronic record in terms of Information & Communication Technology Act, 2006 and rules there under as applicable and as amended from time to time. As such, this document does not require any physical or digital signatures and forms a valid and binding agreement between the Website and the User. If any content set out herein does not follow  “Digital Commerce Operation Guidelines 2021”, the content will be deleted from the  platform.

 

The authority (jitben.com) reserves 100% rights to change or modify these Terms (including our policies which are incorporated into these Terms) at any time. Please, read this T&C agreement carefully. By accessing and using jitben.com, you are agreed that you have read, understood and accepted the T&C agreement including any additional terms and conditions and any policies referenced herein, available on the website or available by hyperlink.  If you do not want to be bound by this T&C, please do not subscribe to or use the Website or services of jitben.com.

 

Definition of terms 


§  "Agreement" refers to these Terms and Conditions(T&C), the Privacy Policy, any Purchase Order (PO) form and payment instructions provided to you;

§  "Privacy Policy" represents the policy displayed on jitben.com which details how we collect and store your personal data;

§   "you", "your" and "yours" refer to you (the person accessing jitben.com) and placing orders for product/goods or services from the website or from any other channel provided by jitben.com;

§  "we", "us", "our", and "jitben.com" are references to the Company;

§  "Website" means our Website http://www.jitben.com or our mobile apps on which we offer products, goods or services. 


Your jitben.com account:


You will need to create an account on our e-platform (jitben.com) for you to use the e-shopping website.

·         When you create the account, we may ask you to provide your personal information including a valid and current email address, a mobile phone number, national ID number (if required), and a unique password.

·         To place an online Purchase Order (PO), depending on which payment method you select, you may possibly need to provide us with your Debit/Credit card details or other valid mode of payment details.

·         Your unique PIN/password should not be shared with anyone and you agree to keep it secret at all times, and also you are solely responsible for keeping the password safe. Save for cases of fraud or abuse which are not your fault, you wholeheartedly accept that all POs placed under your jitben.com account are your sole responsibility.

·         The authority (jitben.com) shall not be liable for the PO that encounters delivery problems due to partial, incorrect or missing information provided by you in your account. You are bound to provide information that is 100% correct, complete, and authentic for the proper processing of the PO, including your delivery address details and contact information.

·         We only entertain the name of an account holder as the owner of and the client of the product(s) which has been ordered from the respective jitben.com account. 

·         If you want to delete your jitben.com account, you have to send an e-mail to the authority (jitben.com) for the same. Please note that the authority (jitben.com) reserves the right to refuse service, terminate accounts, terminate your rights to use jitben.com’s services, remove or edit content, or cancel orders in its sole discretion, if the authority rationally believes that:

A.       Someone other than you is using your account without your permission; or

B.       Where you are distrusted or exposed or suspected or discovered to have been involved in any action or behavior that is in breach of these T&C, jitben.com policies and rules, or involved in activity or conduct which the authority deems by its sole discretion to be an abuse of the e-site;

C.       Multiple accounts owned by a single user even with different mobile numbers;

Please note that the authority is not bound to provide the balance amount of (cash back/loyalty point) to you if your account is blocked or banned. Any kind of balances paid by you would be refunded to you within a reasonable time period. This calculation may depend on your total payment vs. the cash back you already received and had used.

 

Purchasing Order (PO)/ Your Order:


Your order is an offer to us (jitben.com) to buy product(s), goods, and service.

·         When you place an order to purchase products/goods/ service from us, you will receive a phone call and / or an e-mail or SMS to your mobile phone number confirming receipt of your order containing the details of your order (the "Order Confirmation E-mail and/or SMS").

·         The Order Confirmation E-mail and/or SMS is acknowledgement that we have received your order, but does not confirm acceptance of your offer to buy the product(s) ordered; that when we send the Order Confirmation E-mail and/or SMS a contract called an “agreement to sell” is concluded in accordance with Section 4(3) of the Sale of Goods Act, 1930 i.e. the transfer of the property in the goods is to take place at a future time when the product(s) is/are delivered to your designated address.

·         We only accept your offer, and the above “agreement to sell” becomes a contract of sale for product(s) ordered by you in accordance with Section 4(4) of the Sale of Goods Act, 1930, when the product(s) is/are delivered to your designated address and at that time the property in the goods is transferred from us to you.

·          Any order that you place with us is subject to product availability, product weight and price variance, delivery capacity and acceptance by us. You must inform us immediately if any details are incorrect. You receive an automatic confirmation does not essentially mean that either we will be able to fill your order or your order is confirmed.

·         Once we have sent the confirmation electronic mail or SMS we will immediately check the availability and delivery capacity of product/goods/ services. The confirmation message will specify delivery details including the approximate price and delivery time, slot specified by the system or chosen by you and confirm the approximate price, product weight of the Delivery, Goods and Services ordered. If applicable, order (s) will include delivery fees and applicable tax (e.g. goods and services tax, value-added tax, etc.), if any. 

Minimum Order Value The minimum order value is BDT500/- The PO requires meeting the minimum order value (“MOV”) before the Order is placed and delivered to the client/ customer. If an applicable PO(s) fails to meet the MOV, the customer will have the option to add more products/ Goods to his/her order/ cart.

Special Instructions jitben.com and the vendor (as the case may be) rationally make an effort to comply with the customer’s special instructions (if any) for an order. Nevertheless, in some cases, where this is not practical or commercially sound, jitben.com and/or the vendor reserve the right to proceed to prepare the order as per Standard Operating Procedures (SOP). Neither jitben.com nor the vendor shall be responsible to replace or refund an order which does not conform to special instructions provided by you. And also jitben will take all reasonable care, in so far as it is in our authority to do so, to keep the particulars of your order and payment safe. However, in the absence of negligence on our part we cannot be held liable for any loss you may incur if a third-party (parties) procures unlawful access to any data you provide when accessing or ordering from the Website of jitben.com. Please note that your Order may be subject to additional terms and conditions provided by us as well as the Vendor.


Mode of Payment:


 Payment must be made either at the time of ordering the delivery of product (s), goods or services from us by Debit/Credit card/ Mobile Financial Services (MFS)/other digital payment options or at the time of delivery by cash/ Cash On Delivery (COD). Failure to pay on time will result in the cancellation of your order. The authority (jitben.com) reserves the right to offer extra mode of payments and/or remove existing the existing one, at any time with prior notice on the website. If shopper/ customer opt for paying an online payment method, the payment shall be processed by our 3rd party payment service provider(s). With our respected customer/ shopper’s permission, his or her Debit/ Credit Card / payment information will be stored with our third party payment service provider(s) for the future orders. They authority of jitben.com does not store your card or payment information. The client/customer has to make sure that he or she has sufficient funds on his/ her Debit and Credit Card to make the complete payment of an order. It is noted that jitben.com shoulders responsibility for the payments made on our e-site including refunds, exchange, chargebacks, cancellations, and dispute resolution, provided that a reasonable and justifiable claim has been made in accordance with this T&C. 

 

Supply Policy


·         Jitben.com, itself does not produce or manufacture any product; therefore jitben.com tries to control the quality, but does not give quality assurance for any. Jitben.com believes the manufacturer/ vendor/ supplier are fully capable of assuring the quality of every product.

·         If any user/customer at the time of receiving the order delivery, finds any product injurious to health or threatening to life/ security, please, return the product/goods/services at the time of delivery (immediately) to the delivery person.

·         All products displayed on the website are subject to change and are subject to availability.   That means supplying (all Orders/ POs received by jitben.com) is subject to availability of stock. The Orders/POs can be cancelled by jitben.com due to stock related hitches at any time, and any duration, irrespective of timeframe.

 

 

Delivery Policy of Jitben.com


Since timely delivery is one of our top priorities, so we try to deliver goods/products/services quickly and efficiently at your door-step.  Jitben.com is committed to deliver products according to the GoB  “Digital Commerce Conduct Regulation-2021” (WTO cell, Ministry of Commerce, Circular no: 26.00.000.133.93.026.19.119 dated 04 July 2021).

·         The products/services/ goods which are under advance payment will be sent to delivery channel company within 72 hours upon ordered.

·         Within Dhaka city area the delivery will be made in 5 working days and outside Dhaka city area the maximum delivery time is 10 days.The above two promises are conditional based on availability, reachability and unavoidable circumstances, such as law & order situation, government imposed road blocks, too remote areas or unreachable locations, road accidents, unintentional product damage, floods / earthquakes/ adverse weather conditions, public holidays / protest / strikes/ pandemic / lockdown. Due to unavoidable circumstances delivery time may be longer.

·         Jitben.com shall not take any responsibility of the non-delivery if the following reason occurs: incomplete / wrong address, customer unavailable to receive items, customer did not response phone time and again.

·         Product(s), goods and services will be delivered with minimal charge ( except for some specific campaign/ offer) to the address designated by you at the time of placing order;

·         If your order is missing when you already have paid a portion in advance, jitben shall return your advance within 10 working days. In fact, the product delivery shall depend on the stock availability of the product;

·         We will try our level best to deliver within the time frame stated; nevertheless, we will not be liable for any loss caused to you after you receive the delivery of product/goods and so on. In case of any discrepancy, please contact our customer care unit.

·          Delivery might be delayed due to force majeure events which are included, but not limited to, political unrest, political event, government restrictions, lock-down, national/public holidays/official holiday(s), and so forth.

·         If the products/goods are not available or there is no delivery capacity, or additional information requires, we will also let you know by text message (SMS) or cell phone call.

·          In case of a delayed delivery, the delivery charge will neither be annulled nor refunded by jitben.com. In this case, we possibly will consider any kind of discretion.

·         If customer (s)/ client(s) fails to accept the delivery (product/ goods/ service) at the time they are ready for delivery, or jitben.com is unable to deliver at the nominated address and time due to your failure to provide appropriate instructions, or authorizations, then such product/goods/ service shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass to you. Any storage, insurance and ancillary costs which may incur as a result of the inability to deliver shall be your obligation and you shall indemnify jitben.com in full for such charge/cost.

·         Please note that for delivering fragile and/or sensitive items (example: electronics, home appliances, decorative items, crockeries etc.) delivery charge may be higher than others products;

·         Delivery charge(s) may applicable if seller delivers the product(s).Waiver of the delivery charge(s) may depend on different circumstances such as delivery area, road conditions, transportation cost etc.

·         If collection or delivery of a consignment takes place at your premises, we shall not be under any obligation to provide any equipment or labor or any associated cost(s) which, apart from the driver collecting the Consignment, may be required for loading or unloading of a Consignment. Delivery charge does not include any installation cost. Installation cost (if there is any) is subject to supplier’s policy;

·          Provision of the home delivery in case of multi-vendor is/are subject to carrier and sellers’ delivery policy.

·          If any delivery fails due to customer negligence or any other reason from the customer’s end, then the customer is bound to pay the return courier charge(s) as well as the redelivery charge(s).


Cancellation of Your Oder


·         You ( customer) are required to notify us immediately if you take a decision to cancel your order, preferably by phone, and quote your order number and every details of the order possible;

·         We may cancel a contract /order due to product unavailability, price variance or for any other pertinent and substantial reason. We will inform you if this happens and we will refund any payment that you have made.

·         To put is simply, jitben.com retains a legally enforceable right to cancel any order (s) at its sole discretion prior to dispatch and for any reason which is included but not limited to: the product being mispriced, out of stock, expired, defective, malfunctioned, and containing incorrect information or description arising out of technical or typographical error or for any other substantial reason.  

·         You have the right to cancel your order only if we or our vendor has not yet accepted your order. Should you still decide to cancel your order after it has been accepted by us or the vendor, you understand that you shall forfeit the delivery of your cancelled order and cash-on-delivery may be removed from your list of available payment methods for your upcoming orders.


Return Policy of jitben.com


·         If any customer finds his/her purchased item is damaged/flawed or incorrect/incomplete at the time of delivery, you are requested to contact with us through the relevant return window. Your item may be eligible for price cut or replacement depending on the valid complaint, condition, and class of the item;

·         The product must be unused, unworn, unwashed and without any flaws. If a product is returned to us in an inadequate condition, we reserve the right to send it back to you.

·         The following products are not allowed to be returned: Underwear, Swimwear, Skincare, Cosmetics & Perfumes (once opened), Personal hygiene items such as earrings, wigs, nose pin and combs, Consumables such as cigars and beverages.

·         The product must be returned in the original and undamaged manufacturer packaging / box. If the product was delivered in a second layer of jitben packaging, it must be returned in the same condition with return shipping label attached. Do not put tape or stickers on the manufacturer’s box.

·         For apparatus/ electronics related issues after use or the lapse of the arrival window, we will refer you to the brand guarantee focus (if applicable);

·         You are requested to provide/submit correct documents and evidence regarding your return claim (i.e. unboxing video, receiving invoice, spot-on cellphone number, etc.) and also the product must include the original tags, user manual, warranty cards, freebies and accessories


Three (03) Days Return Policy

ü  The authority (jitben.com) is offering “a-3-day-return-policy” for ensuring the purchaser(s) /shopper(s) are 100% satisfied with product(s) or service at small courier cost/charge. You are requested to provide/submit correct documents and evidence regarding your return/refund claim (unboxing video, receiving invoice, spot-on cellphone number, etc.).

ü  This policy period starts from the time of the first attempted delivery. It has to be noted that returns will ONLY be accepted if the following conditions are met:

ü  Purchased products are not returnable if it exceeds a five-day timeframe after the sale is made

 

Ways to return a product on jitben:

Step 1: First go to jitben.com website and sign in to your “jitben account”.

Step 2: Then go to “My Account” and select your “Account Profile”.

Step 3: Now, from your account profile click on “ORDER HISTORY AND DETAILS”.

Step 4: In this stage, select the product “Details” you want to return. You will see the “Details” option providing your product is “Delivered”.

Step 5: Now, on “Details” page please select the “Product fill Form”, provide explanation why you want to return the product with valid reasons and click on “Request a Return”.

Step 6: Now, pack your received parcel with the product in the original and undamaged manufacturer’s packaging as delivered to you and secure the return label on top of the return package. Please record unboxing video, attach and send us back. Please send back the product to “jitben” with the same delivery agency with charge prepaid within 03 (three) days after received. If the products are Cash On Delivery (COD), then please return products instantly with your explanations. 

NB. Product(s) cannot be returned once received by the customer under COD basis purchased.

 

Replacement Policy of jitben.com


The customer may claim a replacement benefit of the product subject to the following conditions:

·         Serious problems with the product (such as: broken product, torn, wrong size, product not working, product does not match with the picture at all, etc.;

·         The product MUST BE 100% intact with the box;

·         Within 24 hours (Maximum) after receiving the delivery (product), the customer has to lodge a complaint to complain@jitben.com  


Refund Policy of jitben.com


The customers are requested to submit correct documents and evidence regarding your refund claim. jitben will process customer’s refund based on the following method:

(A)Refund from returns - Refund is processed once your item is returned to jitben’s warehouse and QC is successfully completed. (B) Refunds from cancelled orders - Refund are automatically started once cancelation is successfully processed. (C) Refunds from failed deliveries - Refund process starts when the item has reached the seller. Please take note that this may take more time depending on the area of your shipping address.

·         To get refund, at first, inform us through an e-mail to info@jitben.com or call us at 01810198750 (10am-6pm). Please, note that to avail a full refund, you have to send the product our office in absolutely good condition at your own cost.

·         The COD refund process may take up to five (05) working days or more depending upon the payment service gateway provider’s clauses. The refund will be begun within the same payment channel but jitben.com has the right to consider/reconsider refund via another flexible channel(s) to make the refund system faster or to make it easier for the customer.

·         If the cancellation was made in time before the delivery vehicles/ couriers are dispatched, we will refund or re-credit your debit or credit card with the full amount within 10 working days. If the refund is not adjusted within 10 working days of initiating, you have to call us on 01810198750, during 10:00AM-6:00 PM to get further assistance. Please note that you have to lodge an application or mail us at complain@jitben.com for a refund within 24 hours after delivery of your product or contact us at 01810198750.

·         In the unlikely event that our delivery team delivers a wrong/damaged item, you have the right to reject the delivery of the wrong item before receiving and you shall be fully refunded for the missing/wrong/damaged item. If the delivery team does a partial delivery (a few items may not be available), we will let you or may well in advance propose a replacement for missing items. You have the right to refuse a partial order before delivery and get a refund.

·         You will not be eligible for any extra cash back/bonus against your principal amount in case of refunds. And also jitben.com is not bound to pay any kind of service charge or cost for the refunded amount.

·         In case of advance payment made by the customer, due to the unavailability of the product  or out of stock or disinterest of customer, the same account number ( with jitben.com) by which advance payment was made will be entertained; Please note that regarding BOGO offer, refund/replacement policy will NOT be applicable.

·         In case of online Payment Orders Refund: You have the right to claim a refund for a cancelled order only if we or our vendor has not yet accepted your order. Should you still decide to cancel your order after it has been accepted by us or the vendor, you understand that NO refund (whether in whole or in part) will be made to you. Consequently, you forfeit the delivery of your cancelled Order.

·         Modes of Refund: In case of Bank Deposit, the bank account details provided by the customer must be correct and the account must be active and should hold some balance. Regarding Debit Card or Credit Card, If the refunded amount is not reflecting in your card statement after the refund is completed and you have received a notification by jitben, you are requested to contact your personal bank. In terms of bKash / Rocket Mobile Wallet, similar to bank deposit, the amount will be refunded to the same mobile account details which you inserted at the time of payment. Talking about Refund Voucher, the Vouchers will be sent to the customer registered email ID on jitben.com and can be redeemed against the same email ID.


Following cases products shall not be eligible for return or replacement:

Incidental damage due to malfunctioning of product;

·         Any consumable item which has been used/installed;

·          Products with tampered or missing serial/UPC numbers;

·         Damages due to misuse of product;

·         Digital products/services;

·          Any damage/defect which are not covered under the manufacturer's warranty;

·         Any product that is returned without all original packaging and accessories, including the box, manufacturer's packaging if any, and all other items originally included with the product/s delivered;

·         If jitben.com has any suspicion or knowledge that any of its buyers and sellers are involved in any activity that is intended to provide claims or information that is false or not genuine, jitben.com may also, while reserving its rights to initiate civil and/or criminal proceedings against such member buyers and sellers, at its sole discretion, suspend, block, restrict, cancel the Display Name of such buyers and sellers and/or disqualify that user and any related users from availing protection through this program. Customers who have been blocked for any suspicious or fraudulent activity on the site will not be allowed to return their products.

·         Jitben.com reserves its right to initiate civil and/or criminal proceedings against a user who, files an invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, jitben.com may at its sole discretion suspend, block, restrict, cancel the Display Name [and its related Display Names] of such user and/or disqualify that user and any related users from availing protection through this program. Any person who, knowingly and with intent to injure, defraud or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.

 

Promotional Activities of jitben.com


To promote its services, goods and products jitben.com uses a wide range of sales promotion, publicity, direct mail, exhibition, packaging, commercials which are truthful and are not misleading or unfair to the best of our understanding and belief. All users are requested to go through the related information contained in the Website before using our service and it will be assumed that every user is aware of every piece of information given on the Website. Images or figures of products, goods and services in the Website are for and by reference ONLY and actual product may differ from the corresponding image/figure exhibited on the website. The Website disclaims any liabilities arising out of any discrepancies to this end to the fullest extent permitted by law. Any short term or long term promotional activities or offer(s) are by default valid for a single order within the offered time frame under any specific account of jitben.com, although we reserve the right to change this policy at any time without prior notice. Any suspicious or abusive practice from your account/ under your patron during any offer or promotion might result in cancellation of your order. In this case, we (jitben.com) reserves 100% right to do so for protecting the benefit of other customers. Account that tends to abuse any offer or promotional activities by any means on our platform (jitben.com) can also get terminated from our online platform. Discount code(s) offered to any/all segment of customer(s) through different marketing channels might get disabled or extended by us (jitben.com) at any time without any prior notice. Any voucher discount code can only be applied once. The leftover amount will not be refunded or used for the next purchase even if the value of the order is smaller than the voucher value. The delivery charge may vary or may be changed time to time. Customer has to agree on the changed charges.

 

Website (jitben.com) Policies, Modification, and Severability


You are requested to review our other policies that are posted on this site. The authority (jitben.com) reserves the right to make changes to our site, policies, T&C at any time. If any of these T&C shall be deemed invalid, null and void or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining terms and conditions. If you use jitben.com, you will be responsible for maintaining the confidentiality of your username and password and also you will be responsible for all activities that take place under your username/ account and you will be under the obligation to restrict access to your computer or mobile phone to prevent unauthorized access to your account. You should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner. 


Some Additional T&C:


·         You (customer/user/client) should not use our website (jitben.com) at all that causes, or is probably going to cause, the site or access to it to interfere, harmed or disabled in any capacity. You should not exercise anything that may hurt or conceivably hurt the website, its workers, officials, partners or some other lawful gathering or in a roundabout way connected with the Site or access to it to be interfered, abused or weakened in any capacity. You understand that you, NOT us, are answerable for every single electronic correspondence and substance sent from your PC/ account to us and you should use jitben.com for legal purposes as it were.

·         Our website (jitben.com) might have cookies. You should have cookies allowed on your computer in order to all functionalities on this website to work properly.

·          We (jitben.com) do not give one-hundred per cent quality assurance of products that we do not produce. Nonetheless, we use our best endeavors to control the highest quality. We have confidence in the manufacturers/ vendors/ suppliers that they are fully capable of assuring the quality of every product;

·         Allergens – Jitben.com is not bound to provide ingredients’ information or allergen information on its e-shopping site. Moreover, jitben.com does not guarantee that the products/Goods sold by the vendors are free of allergens. If you have allergies, allergic reactions or dietary restrictions and requirements, please contact the Vendor or physician or dietary expert before placing a PO with jitben.com.

·         If any user, at the time of receiving the order delivery, finds any product injurious/ threatening to health/ life/ security, we will take full responsibility and will accept return of that product. However, if you face any threat after one day of the delivery of item (s), we will consider it as a lacking within the quality assurance from the manufacturers or suppliers;

In case of any dispute regarding the Terms and Conditions (T&C), the English version of this document shall prevail. The English language version of this T&C shall administer all relevant aspects and shall prevail in case of any contradictions with the translated Bengali version.
